LEGAL ASPECTS OF WASTE SELECTIVE COLLECTION

The current paper has as its focus the study of the legal aspects that regulate the urban solid waste management in Brazil, and, particularly, in the municipality of Rio de Janeiro. The study is based on the Constitution, enacted in 1988, and try to analyze the way in which the Brazilian government regulates the subject. It verifies that the implementation of selective collection is a fundamental factor for the perfect development of the National Program of Solid Waste (PNRS – Programa Nacional de Resíduos Sólidos), given that the solid waste must be selected, recycled and reintroduced in the production chain, saving natural resources, generating income, and, consequently, development. The study of the national laws regarding the matter allows the conclusion that there is a strong regulation in what regards this subject, and everybody agrees about the necessity to implement programs of selective collection.Downloads
